TERMS OF SERVICE

1. INTRODUCTION

These Terms of Service ("Terms") govern your access to and use of the executive performance optimization services ("Services") provided by René van de Schraaf ("Coach," "we," "us," or "our"), including but not limited to:

Cellular activation protocols and nutrigenomic optimization programs
One-on-one consultations (virtual and in-person)
Personalized health diagnostics and protocol development
Movement, recovery, and cognitive optimization strategies
24-hour messaging support and travel resilience protocols

By engaging our Services, you ("Client," "you," or "your") agree to be bound by these Terms. If you do not agree to these Terms, do not use our Services.

2. SERVICES DESCRIPTION

2.1 Program Offerings

We offer three primary service tiers:

Foundation Activation (12 weeks): Comprehensive cellular health optimization for first-time clients and executives with moderate international travel demands
Executive Intensive (6 weeks): Accelerated protocol for C-suite executives and founders requiring rapid, measurable results
Performance Maintenance (ongoing): Quarterly check-ins with protocol updates based on latest research and seasonal demands

2.2 Scope of Services

Our Services include:

Comprehensive intake and health diagnostics
Custom Nrf2 activation protocols using evidence-based nutrigenomic interventions
Personalized movement and recovery optimization strategies
Real-time support via secure messaging during business hours
Travel resilience protocols for international executives
Periodic protocol adjustments based on biomarker feedback

2.3 What We Do NOT Provide

Our Services do NOT include:

Medical diagnosis, treatment, or prescription of medications
Emergency medical services or crisis intervention
Legal, financial, or business advisory services
Guarantees of specific health outcomes or performance metrics

3. CLIENT RESPONSIBILITIES

3.1 Eligibility and Consent

By engaging our Services, you represent and warrant that:

You are at least 18 years of age
You have the legal capacity to enter into these Terms
You are not prohibited by law from accessing our Services
All information you provide is accurate, current, and complete

3.2 Medical Clearance

You acknowledge that:

Our Services are NOT a substitute for medical care
You are responsible for consulting your physician before beginning any optimization protocol
You will immediately inform us of any medical conditions, medications, or health changes that may affect your participation
You will seek immediate medical attention for any urgent health concerns

3.3 Protocol Compliance

You agree to:

Follow recommended protocols consistently and provide honest feedback
Track requested metrics and submit data as agreed
Notify us promptly of any issues, side effects, or concerns
Attend scheduled consultations or reschedule with at least 24 hours' notice

3.4 Supplement Purchases

You acknowledge that:

Recommended supplements (including Protandim Nrf2 Synergizer) are purchased separately and are not included in program fees
Supplement costs are approximately €50/month and are your responsibility
We may receive commissions on supplement purchases through our affiliate relationship with LifeVantage
You are free to source supplements independently, though we recommend our verified supplier for quality assurance

4. PAYMENT TERMS

4.1 Fees

Current program fees are:

Foundation Activation: €4,500 (12 weeks)
Executive Intensive: €6,000 (6 weeks)
Performance Maintenance: €750 per quarter (ongoing)

Fees are subject to change with 30 days' notice for new clients. Existing clients' fees remain locked for the duration of their current program term.

4.2 Payment Schedule

Full payment is due upon program enrollment unless alternative arrangements are agreed in writing
Payment plans may be available for Foundation Activation and Executive Intensive programs
Performance Maintenance is billed quarterly in advance

4.3 Refund Policy

Foundation Activation and Executive Intensive: Full refund if cancellation occurs within 7 days of program start with no consultations completed
After 7 days or first consultation: No refunds. We do not offer performance guarantees or money-back guarantees based on results
Unused sessions: May be rescheduled within 90 days of original booking
Performance Maintenance: Refunds prorated for unused quarters if cancelled with 14 days' notice

4.4 Late Payment

Late payments may result in suspension of Services until account is current. A late fee of 5% per month may be applied to overdue balances.

5. CONFIDENTIALITY AND DATA PROTECTION

5.1 Client Information

We treat all client information as confidential, including:

Health data, biomarkers, and medical history
Personal information shared during consultations
Progress reports and protocol details

5.2 Data Use

We may use anonymized, aggregated data for:

Research and protocol optimization
Case studies and educational content (with explicit consent only)
Quality improvement and service enhancement

5.3 Data Security

We implement reasonable security measures to protect your data, including:

Encrypted communication channels for sensitive information
Secure storage of client records
Limited access to authorized personnel only

6. LIMITATION OF LIABILITY

6.1 No Medical Advice

Our Services provide performance optimization coaching based on nutrigenomic science. We do NOT provide medical advice, diagnosis, or treatment. You acknowledge that:

We are not acting as your physician or healthcare provider
Our recommendations are educational and advisory in nature
You should consult appropriate medical professionals for health concerns

6.2 Results Disclaimer

While we employ evidence-based protocols, individual results vary. We make NO guarantees regarding:

Specific health outcomes or performance improvements
Timeframes for achieving results
Suitability of protocols for your unique physiology

6.3 Liability Cap

To the maximum extent permitted by law, our total liability for any claims arising from or related to our Services shall not exceed the total fees you paid for Services in the 12 months preceding the claim.

6.4 Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from:

Your misuse of our Services
Your failure to follow medical advice from healthcare providers
Your violation of these Terms
Any false or misleading information you provide

7. INTELLECTUAL PROPERTY

7.1 Our Content

All materials provided as part of our Services, including:

Protocol documents and optimization strategies
Educational content and research summaries
Assessment tools and tracking templates
Proprietary methodologies and frameworks

remain our intellectual property. You receive a limited, non-exclusive, non-transferable license to use these materials solely for your personal optimization purposes.

7.2 Restrictions

You may NOT:

Share, reproduce, or distribute our materials to third parties
Use our methodologies for commercial purposes
Reverse-engineer or copy our proprietary protocols
Remove copyright or proprietary notices from any materials

8. TERMINATION

8.1 Termination by Client

You may terminate Services at any time with written notice. Refunds are subject to Section 4.3.

8.2 Termination by Coach

We reserve the right to terminate Services immediately if you:

Violate these Terms
Provide false or misleading information
Engage in abusive, threatening, or inappropriate behavior
Fail to make required payments
Demonstrate non-compliance that jeopardizes the coaching relationship

8.3 Effect of Termination

Upon termination:

Your access to ongoing support and consultations ceases
You retain access to materials already provided
Outstanding fees become immediately due
Both parties' confidentiality obligations continue

9. GENERAL PROVISIONS

9.1 Modifications

We reserve the right to modify these Terms at any time. Changes will be posted on our website and communicated to active clients. Continued use of Services after changes constitutes acceptance.

9.2 Governing Law

These Terms are governed by the laws of the Netherlands. Any disputes shall be subject to the exclusive jurisdiction of the courts in the Netherlands.

9.3 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding our Services.

9.4 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions remain in full effect.

9.5 Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

9.6 Assignment

You may not assign or transfer your rights under these Terms without our written consent. We may assign our rights and obligations without restriction.
